Terms of Service

These terms are a deal between you and DESK36 LTD (Company number 17202704), trading as Watercolour Genius. We've kept them short and written them in language that humans actually understand. By using Watercolour Genius, you agree to these terms.

The deal in a nutshell

We provide an AI-powered service that turns your photos into watercolour art. You upload photos, pick a style, and we generate artwork for you. Some features are free; others cost credits that you can purchase. These terms set out the rules for both sides.

Your account

You need an account to use Watercolour Genius. When you create one, you get 6 free credits to try things out — no credit card required.

You're responsible for keeping your login details secure. If you think someone has accessed your account without permission, let us know straight away at [email protected].

You must be at least 16 years old to create an account.

Credits and payments

How credits work

Credits are the currency of Watercolour Genius. Creating a draft watercolour costs 3 credits. Upscaling to HD costs 7 credits. You start with 6 free credits when you sign up. After that, you can purchase more in bundles.

Purchases and refunds

Credit purchases are processed by Stripe and are non-refundable once completed, because credits are delivered instantly to your account. However — if a generation fails for any reason on our end, we automatically refund the credits used for that generation. No arguing required.

Credits don't expire

Purchased credits stay in your account for as long as your account exists. We won't take them away. Free signup credits work the same way.

About the AI

Our service uses artificial intelligence to generate watercolour-style artwork. A few things worth understanding:

Results vary. AI generation is creative by nature. Two identical requests might produce different results, and we can't guarantee a specific outcome. That's part of the magic — but it also means we can't promise you'll love every generation.

Your photos aren't used for training. The photos you upload are used solely to generate your artwork. They are not fed into any AI training dataset.

We may change providers. We use third-party AI providers (currently fal.ai and Google Gemini). We may switch or add providers over time to improve quality. The core promise — turning your photo into a watercolour — stays the same.

Who owns what

Your stuff

You own the photos you upload. By uploading them, you give us permission to process them through our AI pipeline to generate your artwork — and that's it. We don't claim any rights over your photos beyond what's needed to provide the service.

Generated artwork

The watercolour images we generate are created using AI based on your photo and chosen settings. You receive a licence to use the generated artwork for personal purposes. The exact legal status of AI-generated images is still evolving in many jurisdictions, and we encourage you to check local laws if you plan to use artwork commercially.

Our stuff

The Watercolour Genius service — the code, design, branding, styles, and prompts — belongs to us. You're welcome to use the service, but please don't copy or replicate it.

Reliability

We do our best to keep Watercolour Genius running smoothly, but we can't promise 100% uptime. Sometimes things break, services go down for maintenance, or the AI providers we depend on have outages. We'll always try to be transparent about issues and get things fixed quickly. If a generation fails due to a service issue, your credits are refunded automatically.

Limits on our responsibility

We provide Watercolour Genius "as is". We work hard to make it great, but we can't guarantee it will always be perfect, error-free, or exactly what you expected.

To the extent permitted by law, our total liability for any claims related to the service is limited to the amount you've paid us in the 12 months before the claim. We're not liable for indirect or consequential damages.

This doesn't affect any rights you have as a consumer that can't be limited by contract under the law that applies to you.

Closing your account

You can leave at any time. Email us at [email protected] and we'll close your account and delete your data.

We may close accounts that violate these terms — for example, uploading illegal content or abusing the credit system. We'll explain why if this happens.

When an account is closed, any remaining credits are forfeited. We recommend downloading your favourite artwork before requesting deletion.

Changes to these terms

We may update these terms from time to time. If we make changes that meaningfully affect your rights, we'll give you notice — either by email or a prominent message on the site — and give you time to review before they take effect. Continued use of the service after changes means you accept the new terms.

Legal bits & your rights

These terms are governed by the laws of England and Wales. If we have a dispute, we'll try to sort it out informally first — most things can be resolved with a conversation.

We process your personal data in accordance with the UK General Data Protection Regulation (UK GDPR). You have the right to access, rectify, or erase your data. If you feel your rights have been violated, you can complain to us directly, or to the Information Commissioner's Office (ICO).

If any part of these terms turns out to be unenforceable, the rest still stands.
